As a Refer-a-Friend member (a “Referrer”), you are subject to Nanit’s Terms of Use and Nanit’s Privacy Policy (both available on our website), as well as the following additional Terms & Conditions for Nanit’s Refer-a-Friend program:
Eligibility
Referrers and Referred Friends must be at least 18 years of age. Eligibility is limited to individuals only. The Referred Customer and the Referrer cannot be the same person (for example, by using a different email address).
Successful Referrals
For each Referred Friend that successfully places their first-time Nanit order on www.nanit.com using the Referrer's personal link, the Referrer will receive a referral incentive (“Referral Reward”). The Referrer's Referral Reward will be delivered via email after the Referred Friend places his or her first-time order. You are limited to one Qualified Referral for each Referred Customer; in other words, additional/repeat purchases made by a Referred Customer are not counted as additional Qualified Referrals.
Referral Rewards
For you to earn referral rewards as a Referrer, the Referred Customer must meet both of the following conditions: (1) the Referred Customer must arrive at www.nanit.com by clicking your personal Refer-a-Friend program link and (2) the Referred Customer must meet any conditions as set forth in the referral offer at the time of purchase, which may include marketing opt in, spend thresholds, specific product purchases, and/or order placement dates.
The Referral Reward is set by Nanit in its sole discretion and is subject to change at any time. The Referral Reward may vary by market or within a particular market. Nanit, at its sole discretion, may make available certain promotions with different Referral Rewards. These promotions, unless offered to you, shall have no bearing whatsoever on your Agreement or relationship with Nanit.
Email and SMS Opt In
By participating in this Referral Program, you agree to receive emails from Nanit related to this Referral Program (even if you may have opted out of marketing emails from Nanit previously). You also agree that Nanit will not send emails to any Referred Friends who have opted out of marketing emails from Nanit previously. When participating in this Referral Program as either the Referrer or Referred Customer, you may have the opportunity to opt in to Email and SMS marketing. You may opt out of Email and SMS marketing at any time.
No Spam
You must comply with all up-to-date “SPAM” laws. For example, emails must be created and distributed in a personal manner and bulk email distribution is strongly discouraged. Any distribution of your referral link that could constitute unsolicited commercial email or "spam" under any applicable law or regulation is expressly prohibited and will be grounds for immediate termination of your account and exclusion from Nanit’s Refer-a-Friend program.
Offer Restrictions
The Refer a Friend Offer is only valid at www.nanit.com. No substitutions or cash equivalent. Cannot be combined with other discounts or with cash.
Prohibited Uses
This offer is made to you, the Referrer, solely for your personal referrals. You are not permitted to: (i) distribute or commercialize this offer through any third party site, or (ii) as the Referred Friend, attempt to redeem multiple first-time offers. Anyone found in violation of these prohibited uses or these Official Rules, including the Terms of Use and Privacy Policy, will be subject to Nanit’s remedies.
In the event of a dispute, all redemptions will be deemed to have been redeemed by the owner of the e-mail account used to place the order that is associated with the offer's redemption. For these purposes, the e-mail account holder shall mean the natural person assigned to the e-mail address by the Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with such email account.
Right to Close Accounts
Nanit reserves the right to close the account(s) of any Referrer and/or Referred Customer and to request proper payment if the Referrer and/or Referred Customer attempts to use the Nanit Refer-a-Friend program in a questionable manner or breaches any of these Terms & Conditions or is in violation of any law, statute or governmental regulation.
Right to Cancel Program or Change Terms
Nanit reserves the right to cancel the Refer-a-Friend Program or to change these Terms & Conditions at any time in its sole discretion. Any unclaimed referral rewards will be forfeited at that time.
Remedies
Nanit reserves the right to cancel, suspend and/or modify this Refer a Friend Offer at any time for any reason. Nanit also reserves the right to not honor the outstanding offers, or any portion of them, if any fraud, technical failures or any other factor beyond Nanit’s reasonable control impairs the integrity or proper functioning of the offer or the program, as determined by Nanit in its sole discretion. Nanit reserves the right, in its sole discretion, to take action against anyone it finds to be tampering with the operation of the offer or to be acting in violation of these Official Rules or any other promotion. Any who engage in any Prohibited Uses or otherwise violate these Official Rules, may be inhibited from redeeming any future offer, or from using Nanit’s services altogether, in Nanit’s sole discretion. Any attempt by any person to deliberately undermine the legitimate operation of the offer may be a violation of criminal and civil law, and, should such an attempt be made, Nanit reserves the right to seek damages from any such person to the fullest extent permitted by law.
Waiver
Nanit’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision.
